2. Nature of the Activity

The offered services consist of guided outdoor hiking activities in Gran Canaria.

Activities may include:

Mountain hiking
Ravine and trail walking
Optional nude hiking experiences (non-sexual in nature)
Gay Island Experiences
Private guided island tours

All activities take place in natural environments and involve inherent risks associated with outdoor sports.

3. NATURE OF PRIVATE TOURS

A Private Tour means that the booked guided tourism service is reserved exclusively for the client or the client's group during the agreed tour hours.

A private booking does not constitute personal companionship, friendship, dating, romantic interaction, social escort services, sexual services, private holiday companionship or personal availability outside the booked tourism service.

The guide maintains a professional relationship with participants at all times.

Social interaction, conversation, meals, drinks and stops during the tour may naturally form part of the experience, but they remain within the context of a professional guided tourism service.

The guide is not required to participate in private social activities before or after the booked tour.

4. PRIVATE TOUR PLANNING AND COMMUNICATION

Private tours are flexible and may be adapted to the client's interests, weather conditions, accessibility, safety and local circumstances.

The exact itinerary does not need to be fixed at the time of booking.

Detailed route planning is normally completed within 24–48 hours before the activity, or on the morning of the activity where appropriate.

Reasonable pre-tour communication concerning meeting points, interests, physical ability, timing and practical arrangements is included.

Continuous personal communication, extensive itinerary consultation, repeated planning sessions or communication unrelated to the booked tourism service are not included in the booking.

GayTourGC reserves the right to limit communication to matters reasonably necessary for delivering the booked service.

5. BOOKING AND PAYMENT

Bookings must be completed through the official GayTourGC booking system or another booking method expressly accepted by GayTourGC.

Unless otherwise stated:

Full payment is required to confirm the booking.
A booking is confirmed once payment has been successfully received.
The selected date and capacity may then be reserved specifically for the participant.

By completing a booking, the participant confirms acceptance of the Terms & Conditions applicable at the time of booking.

6. BOOKING AND PREPARATION FEE

20% of the total booking value constitutes a booking and preparation fee.

This fee covers costs associated with reservation administration, scheduling, route preparation, communication, vehicle arrangements, operational planning and capacity reserved for the participant.

Once the booking has been confirmed, this 20% booking and preparation fee is non-refundable in the event of voluntary cancellation by the participant, except where otherwise required by applicable law or where GayTourGC cancels the activity.

7. PARTICIPANT CANCELLATION

If a participant cancels:

More than 48 hours before the scheduled activity:

80% of the booking value may be refunded.
The 20% booking and preparation fee is non-refundable.
Where possible, GayTourGC may alternatively offer rescheduling.

Within 48 hours of the scheduled activity:

The booking is non-refundable.
No-show:
No refund will be provided.

A participant who voluntarily chooses not to continue with a confirmed booking remains subject to the cancellation conditions above.

8. MULTIPLE BOOKINGS

Where a participant has booked more than one activity, each confirmed activity is treated as a separate booking unless expressly sold as a package.

Cancellation of one activity does not automatically cancel other bookings.

A participant wishing to cancel multiple activities must clearly identify which bookings are to be cancelled.

9. MINIMUM GROUP SIZE

Certain activities require a minimum number of participants.

If the minimum group size is not reached, participants may be offered:

An alternative date
Another suitable activity
A full refund for the affected activity

Participants from different booking dates may be consolidated into one group where operationally appropriate.

10. ORGANIZER CANCELLATION OR MODIFICATION

GayTourGC reserves the right to cancel, postpone, modify or adapt an activity where reasonably necessary due to:

Insufficient group size
Adverse weather
Trail or road closures
Safety concerns
Wildfire risk
Natural hazards
Vehicle or operational problems
Government restrictions
Force majeure
Circumstances outside the organizer's reasonable control

Where GayTourGC cancels an activity entirely and no suitable alternative is accepted, the participant will receive a refund for the affected activity.

Changes to the itinerary, route, stops or sequence of the tour for safety, weather, traffic or operational reasons do not automatically constitute cancellation of the service.

11. INSURANCE COVERAGE

Activities are covered, where applicable, by:

Professional Liability Insurance
Personal Accident Insurance
Additional insurance required for registered active tourism activities

Participants may be required to provide identification or other information necessary for insurance activation.

Insurance is subject to the conditions, exclusions and limits of the applicable insurance policy.

12. PARTICIPANT RESPONSIBILITY

Participants are responsible for ensuring that they are reasonably capable of participating in the selected activity.

Participants must:

Provide truthful information regarding relevant physical limitations where necessary for safety
Follow instructions given by the guide
Use appropriate footwear and clothing
Carry adequate water where instructed
Behave responsibly in natural environments
Comply with applicable laws and safety requirements

Participants who have concerns about difficulty or suitability should contact GayTourGC before booking.

13. CODE OF CONDUCT AND PERSONAL BOUNDARIES

GayTourGC is based on respect, consent, privacy and professional boundaries.

Participants must behave respectfully toward:

The guide
Other participants
Local residents
Third-party service providers
The natural environment

The following may result in refusal of participation or immediate termination of the activity:

Harassment
Unwanted sexual behaviour
Intimidation
Aggressive behaviour
Repeated disregard of personal boundaries
Dangerous conduct
Serious disruption of the activity
Discriminatory or abusive behaviour
Refusal to follow reasonable safety instructions

Where participation is terminated because of the participant's serious misconduct, no refund will be provided.

14. NUDE HIKING POLICY

Nude hiking, where offered, is optional and non-sexual.

Participation is based on:

Consent
Mutual respect
Discretion
Body positivity
Respect for personal boundaries

Nudity does not imply sexual consent or sexual availability.

The following are strictly prohibited:

Sexual activity during the activity
Unwanted sexual contact
Harassment
Sexual pressure
Photographing or recording another participant without explicit consent

The organizer may refuse or remove any person who does not respect these principles.

15. PHOTOGRAPHY AND PRIVACY

Participants must obtain explicit consent before photographing or recording another participant.

GayTourGC will not publish identifiable photographs or videos of participants for promotional purposes without appropriate consent.

Participants are responsible for respecting the privacy of other guests.

16. TRANSPORT AND MEETING POINTS

Meeting points, pickup arrangements and transport conditions are specified in the relevant activity description or booking confirmation.

Participants must arrive at the agreed meeting point on time.

Delays caused by a participant do not automatically entitle that participant to an extension of the activity or a refund.

For private tours, hotel pickup may be arranged where expressly agreed.

17. THIRD-PARTY COSTS AND SERVICES

Some tours may involve third-party services, entrance tickets, food, drinks, attractions or other optional expenses.

Unless expressly stated as included, such expenses are payable separately by the participant.

GayTourGC is not responsible for independent services supplied directly by third-party businesses, except where responsibility arises under applicable law.

18. LIMITATION OF LIABILITY

GayTourGC takes reasonable measures to operate activities safely and professionally.

Participants acknowledge that outdoor and mountain activities involve inherent risks that cannot be entirely eliminated.

Subject to applicable law, GayTourGC is not responsible for loss or injury resulting from:

Failure to follow safety instructions
Reckless behaviour
Undisclosed relevant health or physical limitations
Loss or damage to personal belongings
Risks inherent to the activity that could not reasonably have been prevented

Nothing in these Terms excludes liability that cannot legally be excluded under Spanish law.

19. FORCE MAJEURE

GayTourGC is not responsible for failure or delay caused by circumstances outside its reasonable control, including severe weather, wildfire, natural disasters, road closures, government restrictions, civil emergencies or similar events.

Where possible, an alternative date, route or activity may be offered.

20. CHANGES TO THESE TERMS

GayTourGC may update these Terms & Conditions from time to time.

The version applicable to a booking is the version made available to the participant at the time that booking is concluded.

Updated Terms apply to bookings made after their effective date unless otherwise agreed or required by law.

21. GOVERNING LAW AND CONSUMER RIGHTS

These Terms & Conditions are governed by Spanish law.

Nothing in these Terms limits any mandatory consumer rights available under applicable Spanish or European Union law.

Any dispute shall be handled in accordance with the jurisdiction and consumer-protection rules applicable under Spanish law.
